Bankruptcy Protections for GPU Financiers Differ from Other Assets
Unlike financiers of aircraft, ships, and railcars, who are granted statutory 60-day repossession rights under U.S. Bankruptcy Code sections such as Section 1110, GPU lenders are subject to the standard automatic stay throughout a neocloud's bankruptcy proceedings. Given the rapid depreciation of GPU servers with each NVIDIA generation and their frequent status as a neocloud's sole operational assets, lenders presently must establish protections contractually through genuine leases, detailed UCC schedules, and colocation access arrangements.
